Disqualification bids vs presidential, VP bets junked

MANILA, Philippines—The Commission on Elections (Comelec) threw out the disqualification cases filed against four major contenders in the presidential and vice presidential race accused of premature campaigning.

The Comelec First Division composed of Commissioners Rene Sarmiento, Armando Velasco and Gregorio Larrazabal “dismissed for lack of merit” lawyer Ely Pamatong’s petition to bar from running Senators Benigno “Noynoy” Aquino III, Manuel Villar, former defense chief Gilbert “Gibo” Teodoro and Manuel “Mar” Roxas II.

In his petition, Pamatong said the four engaged in premature campaigning or partisan political activity ahead of the campaign period and before filing their certificates of candidacy (COC)

But on November 25, the Supreme Court ruled that there is no law prohibiting politicians from mounting political advertisements even after the filing of their candidacies and before the start of the official campaign period.

The lawyers of Aquino, Roxas, and Villar were present during the hearing. No lawyer represented Teodoro.

Pamatong, a self-proclaimed author and lawyer who once tried to sue Pope Benedict XVI, said he would file a motion for reconsideration within five days after the promulgation of the ruling.

Last month, Pamatong was jailed for three days after being cited for contempt when he yelled “You’re all thieves” at the election commissioners who were about to announce their ruling on the disqualification case Pamatong filed against ousted president Joseph Estrada and President Gloria Macapagal-Arroyo.

In 2004, he was arrested for throwing metal spikes on EDSA that damaged vehicles and caused a major traffic disturbance.
